MINUTES
BOARD OF HEALTH MEETING
THURSDAY, JANUARY 27, 2011
3PM

PRESENT:        Dr. James Taylor, Chairman, Pat Larivere, R.N., Co-Chairman, Dr. Lois Roth-Johnson,  Beverly Knox, R.N., Dr. Martin Haspel, Jane                                Crowley, M.S., R.S., Health Agent, Susan Barker, Assistant Health Agent

I.      OPENING STATEMENTS

        Ms. Crowley updated the Board on possible dates and times for the upcoming I/A Seminar, she has been in contact with both George Huefelder and Sue      Rask of Barnstable County Department of Health & Environment, final date and time will be discussed with the Board.

II.     VARIANCE

1.      Ralph Santoro           25 John Thomas Rd               Map-20  Parcel-53

        Emily Beebe submitted plans with the following requests for variances:

        TOWN OF EASTHAM REGULATIONS
        1.      The propose well is less than 10’ from the property line.  (2’ separation provided) (Section II.C.5.a.)

        2.      The proposed leach area is less than 100’ from the isolated fresh wetland.  (Section I.C.6.)

        3.      The proposed system does not provide for nitrogen reduction.  (Section I. E.)

        310 CMR 15.211

        1.      The proposed soil absorption system is less than 10’ from the east property line. (7’ separation provided)

        The Board stated that they would like a revised plan submitted which moves that soil absorption system towards the street, and provides for pressure    dosing while    still maintaining vertical separation.

        Pat Lariviere made the motion to continue to the February 17, 2011 meeting.
        Lois Roth-Johnson seconded the motion to continue.

        SO VOTED UNAMIMOUSLY TO CONTINUE

II.     REVIEW

2.      Anthony Schoener                16 Keene Way            Map-19  Parcel-43H

        Andrew Grover of Ryder & Wilcox presented the Board with a plan with requests for a nitrogen reducing technology septic system to be used on a new 5    bedroom residential subdivision using provisional use approval.  The plan includes secondary treatment using an Advantex AX20 treatment unit with a     2500 gallon septic tank.

        Finding that the plan achieves maximum feasible compliance, the plan was        approved with the following conditions:

        1.      Routine water quality and VOC quality tests be provided of proposed well location to assure potability.
        2.      No increase in design flow.
        3.      Secondary treatment and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total                  nitrogen, BOD, TSS, Nitrate (or two times per year for seasonal use).  Effluent nitrate-nitrogen not to exceed 19 mg/L.
        4.      Operation and maintenance agreement to be submitted to EBOH.  Operation and maintenance agreement to be required for the life of the                    system.  Operator to report results via Carmody database provided through Barnstable County Health or directly to the Eastham Health                    Department if not available.
        5.      Deed restriction for 5 bedroom use and use of Advantex AX20 alternative technology requirement to be recorded on deed.
        6.      Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.       
        7.      Any increase in habitable square footage would require Board of Health review.

        Pat Lariviere made the motion to approve the plans with the seven conditions.
        Martin Haspel seconded the motion.

        SO VOTED UNAMIMOUSLY

3.      William Scully  75 Fairview Ave Map-12  Parcel-123&124

        Felco Engineering, Inc. submitted a revised plan to the Board at the time of the meeting.  He was accompanied by Ms. Lisa Still attorney at law                 representing the interests of the possible buyers of this property.

        There are discrepancies regarding the size of the lot, and where the well exists for parcel 125.  A revised engineered stamped plan was submitted showing       accurate lot lines and location of well.  Mr. David Lajoie dated said plan and stated “well to be abandoned” on plan which is filed.

        Finding that the plan achieves maximum feasible compliance, the aforementioned  variance was approved with the following conditions:

        8.      Well to the East to be permanently abandoned and noted on plan.

        Dr. Lois Roth-Johnson made a motion to approve the plan with the eight conditions.
        Martin Haspel seconded the motion.

        SO VOTED UNAMIMOUSLY

4.      Peter Woytowich 95 Kear Dr.             Map-9           Parcel-338

        Mr. James Haverty presented to the Board plans to finish the space above the attached garage as an office.  This space as it is proposed meets the              definitions of a bedroom.  The area would be outfitted with a gas fireplace unit and a full bathroom.

         The Board discussed the possibility with Mr. Haverty of using I/A technology on this property or removing the bathroom.  Future owners could use this  space as a bedroom.  A two bedroom deed restriction is recommended.

        The following was discussed:
        1.      Remove the doorway completely, creating an open hallway from the kitchen area.
        2.      Remove shower from bathroom.
        3.      Create an open rail.
        4.      Deed restriction for 2 bedrooms.

        Dr. James Taylor made the motion to continue the review request so that a plan could be submitted to the Board showing the 4 conditions listed.
        Martin Haspel seconded the motion to continue.

        SO VOTED UNAMIMOUSLY TO CONTINUE

5.      Benjamin Hood   450 Steele Rd           Map-4           Parcel-120

        Mr. Tim Dickey presented the Board with proposed plans for a bathroom and kitchen expansion.  There is no expansion of any existing bedroom or          increase in bedroom number.  There has been a passing septic inspection conducted on the property dated January 10, 2011.  

        The Board asked if it was possible for pressure dosing to be added to plan?

        Pat Lariviere made the motion to continue the review so that a plan could be submitted showing pressure dosing.
        Lois Roth-Johnson seconded the motion to continue.

        SO VOTED UNAMIMOUSLY TO CONTINUE

IV.     REDUCTION REQUESTS

6.      2705 State Highway

        Homeower requests approval to reduce effluent testing of the I/A system to 1 time per year.  Testing to be done in the month of September.

        Pat Lariviere made the motion to accept the request.
        Beverly Knox seconded the motion.

        SO VOTED UNAMIMOUSLY

7.      245 Mary Chase Rd

        Homeowner requested approval to discontinue effluent testing of the I/A system.

        The request to discontinue testing entirely is denied.  Testing is required to be done 2 times per year in the months of May and September.  Annual             operation and maintenance required for the life of the system.

        Pat Lariviere made the motion to reduce the testing to 2 times per year.
        Seconded by Lois Roth-Johnson.

        SO VOTED UNAMIMOUSLY
